Supervisor who forced SSC girl to admit to copying in writing will only lose stipend

Officials at Ghatkopar's Vidya Bhavan School will only lose Rs 25 for extracting a written undertaking (allegedly


false) from Bhavi Desai (15) on March 16, which said the girl had been caught copying during her Std X board exam. Bhavi later jumped to her death from the building were she lived, and the only action that the board can take against the concerned official, experts say, is to cancel their stipend Rs 25.





C Kamble, education inspector in-charge, said, "The principal might have taken an undertaking from the girl as a warning. She might have not done it purposely. But yes, such cases should be handled carefully, as children are very sensitive. The department should hold workshops to train principals to handle students during board exams."

When MiD DAY spoke to the Desais, a family member said the parents don't wish to take any action against the school.

Krishnaji Narayan Shirkande, the joint director, Vidya Bhavan, said, "I don't want to comment on this issue any further, as the matter is being considered by the state board."

Advocate Mubin Solkar said the case would not attract sections of the IPC connected to the abetment of suicide.

"The Supreme Court has made it that as per Section 107 of the IPC, the accused should have instigated, engaged or intentionally provoked for the person to commit suicide. Only then can it attract the penal sections connected with abetment of suicide. Merely reprimanding a student or taking an undertaking as a precautionary step would not be sufficient to sustain charges of abetment of suicide."
