Complainant bows to wishes of Yeddy's office, files withdrawal application

The Chief Minister is helping forensic expert Dr S Malini in coming out of the criminal case filed against her. As expected, a withdrawal application was filed in the court on Thursday.


Succumbing to pressure exerted by the chief minister's office (CMO), the complainant Pradeep Kumar agreed to file the withdrawal application before the VI ACM court.





"We realised that it is very difficult to fight against injustice," said a source close to Kumar. "Some are so powerful that they will not be punished."

However, the magistrate Justice Churi Khan said that he could not decide on it, after admitting the application, and called for an objection from the state public prosecutor because state is the petitioner in the case as the police have filed FIR after the court referred the case to them.

The case is adjourned till February 10.

Pradeep Kumar had registered a private complaint in the court after the police failed to act upon his complaint seeking a stringent action against Malini for cheating the government.

Yeddyurappa had exerted pressure on Kumar through his legal advisor Diwakar as Kumar was Diwakar's junior lawyer during his practice days.u00a0

Yeddyurappa took personal interest in the case because BJP top brass and senior RSS leadrs backed Malini as she has close links with them.

According to legal experts, once the police have filed an FIR, the complainant cannot withdraw his complaint in such cases. The police can file a B-report if there is lack of evidence or the state can withdraw the case after the cabinet approves the proposal.

In all probability, the court might quash the case if the public prosecutor does not object for the withdrawal application, which is most likely.
