Former cricketer and Karnataka State Cricket Association President Anil Kumble won the long pending legal battle yesterday, as the Principal Family Court ruled the judgment on the custody of his step daughter in his favour. M G Sudheendra, while delivering the verdict, said that the girl would stay with her biological mother Chetana and stepfather Kumble. Last week, the judge spoke to the girl in his chamber and she reportedly refused to live with her biological father Jahgirdar. Considering her statement, the court decided against his plea put before the court by Jahgirdar in 2006.

The argument
C V Nagesh, who represented Kumble, argued that Jahgirdar had promised that he would not marry again for his child's sake. But following his marriage, his love for the girl might have changed. The Kumbles feel that the girl may not be happy with her stepmother. On the other hand, she has become fond of to her stepsiblings.

Besides, Kumble is capable of ensuring that she has a good career. "Following the ruling, Jahgirdar objected to Chetana's application seeking permission to take her daughter overseas. However, the court granted her the permission while handing over their passports," Nagesh told MiD DAY


Counter argument
Whereas, Jahgirdar argued that unlike Kumble who has two children with Chetana, he doesn't have any child with his current wife. Besides, his daughter is a teenager and she needs the attention and guidance of her real father, which Kumble may not be able to give, as he's usually away from home because of his profession and business commitments. He told the court that he could take better care of his daughter since he works from home and pointed out that afather-daughter relationship is special and the bond is important for the child's welfare.


Ignorant society
Unhappy with the court's ruling, Jahgirdar plans to move the High Court against the judgement. "I am very disappointed with the order because I have been doing everything, as a father, for my daughter's welfare," he said. Jahgirdar added that he was unable to understand why there is so much gender bias against fathers in the judicial system. "The mindset of our society is covered with a veil of ignorance about the importance of a father's role in the upbringing of a child. I am waiting for the judgment copy and in all probability, will be appeal to the High Court seeking justice to protect the interests and wellbeing of my daughter," he said.
