Cops register a case against the organiser and govinda pathak for flouting rules; 12-year-old is in ICU

Ulhasnagar mandal rapped for minor's fall

A day after a 12-year-old govinda was injured due to his fall from a six-tiered pyramid, the Vitthalwadi police in Ulhasnagar registered a case against the organiser and govinda pathak for violating the Dahi Handi norms.

In a video clip of the incident that mid-day is in possession of, the minor, Sujal Gadapkar, is seen climbing the highest tier with no precautionary measures to protect him and falling down unconscious. He has suffered injuries to his head and chest and is currently undergoing treatment in the ICU of Fortis Hospital in Kalyan.

Taking cognizance, the Vitthalwadi police late on Thursday night registered the case against two people — Rajendra Mane, President of Shivtej Mitra Mandal who organised the event and Yogesh Kailash Dhange, Govinda Pathak of Radhesham Mandal — under sections 308 (Attempt to commit culpable homicide), 337 (Causing hurt by act endangering life or personal safety of others), 338 (Causing grievous hurt by act endangering life or personal safety of others), 188 (Disobedience to order duly promulgated by public servant) and 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code.

Surendra Shirsat, senior police inspector, Vitthalwadi police station said, "We have registered a case against both the organiser and govinda pathak for allowing the formation of six layers, which is against the rules. The current rule only permits four layers upto 20 feet high. Additionally, a minor should not have been allowed on the top, which is a clear violation of the rules."

"We also have the CCTV footage of the incident were the Govinda pathak is clearly seen forming the six tiers and the minor falling down. No arrests have been made yet and further investigations are underway," added Shirsat.

Activist speaks
Raj Asrodkar, a local activist from Ulhasnagar claims that the mandal violated rules and should be booked. "If they would have tied the handi at 20 feet, the incident would never have happened. They have violated the norms because of which the mishap happened. The rules are made not to hurt the community, but to keep people safe," added Asrodkar.
