Nitish Katara case: HC refuses early hearing of Vikas Yadav's parole

New Delhi: The Delhi High Court Friday refused early hearing of a parole plea filed by Vikas Yadav, convicted in the Nitish Katara murder case. Yadav sought the parole to visit his ailing grandfather.


Justice A.K. Pathak refused to hear the plea early even as Yadav's counsel vehemently sought an expeditious hearing of the plea.


Yadav's counsel contended that his client was "suffering" as his right under Article 14 (equality before law) is being violated as Yadav was not treated at par with other convicts.


Seeking parity with other convicts, his counsel argued that "all lifer have been granted parole".

Rejecting the argument, the court asked: "Why should I treat this matter separately...How is he (Vikas Yadav) suffering?"

The court posted the matter for further hearing March 17.

The life sentence awarded to Vikas Yadav and his cousin Vishal Yadav was enhanced to a 30-year jail term without remission for Nitish Katara's murder, who was a friend of Vikas Yadav's sister.

The court Feb 6 had also held that Yadav cousins' numerous hospital visits for treatment were "unwarranted" and they have deliberately manipulated the system.

Vikas Yadav, son of politician D.P. Yadav has sought parole to visit his ailing 93-year-old grandfather. Yadav pleaded that he has been in jail for the past 13 years and his conduct has been good throughout.

The plea has stated that his grandfather had an angioplasty and he wants to spend time with him to take care of him.
