The Apex court said that the elections will be held under the unamended constitution of RCA as per its directions given on February 11, 2005. Earlier, the association had fixed February 22 for the holding of the elections.

The court said that the observer Justice (retd) N M Kasliwal who was appointed by the Association will continue to function and he will be at liberty to appoint Election Officers.
The court was hearing applications filed by RCA president Lalit Kumar Modi and district cricket association supporting him who had alleged that the secretary Subhash Joshi had announced for the date of the elections for executive committee of RCA without taking members into confidence, which is arbitrary.
They have also alleged that there were interference by the Rajasthan government in the RCA elections. The Alwar Association has alleged that the constitution of the RCA was changed in an arbitrary manner without any notice by Secretary Subhash Joshi in connivance with Devaram Chaudhary, a relative of Rajasthan Minister and IAS officer Sanjay Dixit, heading the Barmer District Cricket Association.
Further, the application said since the elections of the RCA for the term 2005-09 were held under the supervision of the apex court, the same procedure ought to be followed for conducting the upcoming election for 2009-13.
Modi, against whom criminal cases have been lodged by the rival faction led by Kishore Rungta for allegedly abusing his official position, has questioned the decision of Joshi for announcing the date of elections without holding the Annual General Meeting (AGM).
