The Ghaziabad court on Friday extended the judicial custody of Raj Kumar, Krishna and Vijay Mandal, the three main accused in the Arushi-Hemraj murder case, to 14 days judicial custody.
The hearing came after Krishna's counsel, R K Anand, had filed an application asking the court for documents like postmortem report, FIR copy, and results of tests conducted on Krishna.
He mentioned that the court had the power to release an accused if there is no evidence against him. Anand also mentioned that CBI had kept Krishna under illegal detention.
However, senior public prosecutor R K Saini declined the requests of releasing Krishna saying that as the investigations are still on the accused couldn't be released.
Co-accused Rajkumar's counsel Sanjay Tyagi had also submitted an application alleging that CBI had tortured his client â both physically and mentally. "I (Rajkumar) do not know Krishna but CBI officials threatened to kill my family if I do not become (a) prosecution witness," the application, made on behalf of Rajkumar, says.
"Earlier on July 12, 2008, Dr Rajesh Talwar -- father of Arushi -- was released after spending more than a month in Judicial custody due to lack of evidence.
