HC grants bail to man held for sexually assaulting 'friend' at Mumbai beach

The Bombay High Court has granted bail to a man arrested for allegedly sexually assaulting a woman at a crowded beach in Mumbai in 2021, noting the victim and the accused were friends and charges against him appear implausible. Judge Prithiviraj Chavan, in an order passed on Wednesday, pointed out that the victim's statement recorded before a magistrate's court revealed she was friends with the accused, and also noted that charges in the three-year-old case have not yet been framed by the trial court. "Since the victim was a major at the time of the alleged offence, prima facie, it does not appeal to one's mind that in broad daylight at a crowded Juhu Chowpatty (beach) on the day Eid-Ul-Fitr, the applicant would commit forcible sexual intercourse with the victim," the HC observed. No sane man would believe it, the judge added. The HC also said that since the victim was an adult at the time of the alleged incident, there was no need to invoke the Protection of Children from Sexual Offences (POCSO) Act against the accused. The accused was booked under relevant provisions of the IPC for rape, outraging modesty of woman, stalking, among others, as well as sections of the POCSO Act. The alleged incident took place on May 14, 2021, when the victim had been to Juhu Chowpatty (beach) in suburban Mumbai along with the accused. He sought sexual favours which the victim refused. However, the applicant then threatened her with dire consequences and sexually assaulted her at an isolated place at the tourist site, the prosecution submitted. The court, in the order, noted there was no need to invoke the POCSO Act against the accused as the victim's age, as per medical reports, was more than 18 years. The applicant is in jail ever since his arrest in June 2021. It is informed that the trial court has not yet framed charges and, therefore, there is no likelihood of bringing the trial to its logical end (anytime soon), the HC noted. Having considered all the aforesaid peculiar circumstances, the application (for bail) is allowed, the Judge said. This story has been sourced from a third party syndicated feed, agencies. Thane cop booked for seeking bribe in case he was probing

A cop from Thane Police in Maharashtra was booked by the Maharashtra Anti Corruption Bureau (ACB) for allegedly seeking bribe in a case he was probing, ACB officials said on Thursday, reported the PTI. The cop, an assistant police inspector (API) was booked for allegedly demanding a bribe in Thane district of Maharashtra, the official said. According to the PTI, API Kailas Jaywant Tokhle of the Crime Unit I of Kashimira police station has not been arrested as yet, the official said. "He sought Rs 10 lakh from a man whose brother is an accused in a cheating and forgery case filed in Virar police station. Tokhle, who is investigating officer in the case, sought the bribe to ensure the accused gets bail," the official said, the news agency reported on Thursday. The Thane unit of the ACB is probing the case further, he added. Meanwhile, last month, the ACB had booked an assistant commissioner of state tax and some other officers of the Maharashtra GST department allegedly for demanding a bribe of Rs 1 crore from a company's director to settle a pending tax matter, officials said. The Anti-Corruption Bureau registered the case under section 7 of the Prevention of Corruption Act against Arjun Suryawanshi, the assistant commissioner of state tax (investigation branch), and other officers on February 2, newswire PTI reported on Tuesday. Section 7 of the act deals with an offence related to a public servant being bribed. The FIR was registered after a letter was written by the special commissioner of state tax and chief vigilance officer to Maharashtra director general of police (ACB) seeking an investigation into the alleged corruption by officers of the investigation branch of the state tax, the officials said. During the probe, it came to light that Suryawanshi and his team conducted raids between July 5 and August 7 last year on a firm, which had an outstanding tax of more than Rs 20 crore, said the official. Despite several reminders, the firm's director did not pay the pending tax, following which the GST department officials visited his office and residence also, he said. On August 21, Suryawanshi allegedly sent a WhatsApp message demanding Rs 1 crore from the firm's director to settle the tax matter, said the official. The bribe demand was confirmed (though no money exchanged hands) during investigation after which the FIR was registered, he said, adding further probe was underway. (with PTI inputs)

They also seized seven mobile phones, 15 SIM cards, nine ATM cards of different banks, two cheque books, two PAN cards and four rubber stamps, senior police inspector Gajanan Kadam said, according to the PTI. Acting on the complaint, Navi Mumbai's cyber police launched an investigation that led to the arrest of 39-year-old Piyush Jawarilal Lodha from Mira Road in the early hours of March 23. During the interrogation, Lodha admitted that he was involved in the scam, he added, the news agency reported on Thursday. Meanwhile, in an another case earlier this month, a 37-year-old Navi Mumbai man fell prey to a cryptocurrency fraud and lost more than Rs 10 lakh. According to a PTI report, fraudsters contacted the man by phone and the Telegram app between February 9 and February 11. Believing the scammers' promises, the Navi Mumbai man transferred Rs 10.61 lakh into numerous accounts as advised. However, despite his investment, the man did not receive the promised rewards. After several unsuccessful attempts to contact the accused, he decided to approach the police and make a complaint, the PTI report further stated. As per the report, the Uran police filed a case of cheating against the fraudsters under the Indian Penal Code and the Information Technology Act. The inquiry into this problem is ongoing. A 48-year-old man from Navi Mumbai allegedly lost Rs 1.36 crore to online scammers who tricked him into investing in stock trading, as reported by news agency PTI on March 17. Mumbai: Man killed for forcing coworker to drink

Pressuring a man to consume alcohol to celebrate Holi resulted in a fatal altercation that caused the death of one individual. The Malad police have booked and arrested 49-year-old labourer Krushna Kamlesh Yadav for killing his colleague Uttam Motichand Chaudhary over a petty issue near Malad railway station on Monday (March 25). According to police sources, Chaudhary was found unconscious around 12.30 pm near Malad railway station. The Malad police rushed him to Dr Babasaheb Ambedkar Municipal General Hospital where doctors declared him dead on arrival. During the initial probe, the police found some injury marks on the back of Chaudhary’s head. An autopsy revealed that the cause of death was intracranial haemorrhage, secondary to head injury, along with hemoperitoneum (bleeding within peritoneal cavity). “Subsequently, we registered a murder case against unknown persons and initiated an investigation,” said an officer from Malad police. Under the guidance of DCP Anand Bhoite and Senior Inspector Ravindra Adhane, PSI Shivaji Shinde and his detection team began the investigation.  They made inquiries and investigated the area near the spot where Chaudhary’s body was found and learned from a local vendor that he had an altercation with Yadav. Yadav allegedly assaulted Chaudhary, who fell to the ground. He then kicked him multiple times in the chest and fled the scene. “Both daily wage labourers, Chaudhary was a native of Uttar Pradesh while Yadav hailed from Bihar.  They slept on the footpath outside the railway station and sometimes under the railway bridge in Malad. Yadav does not consume alcohol, but on the occasion of Holi, Chaudhary forced him to drink. This led to the altercation and Chaudhary’s death,” the officer added. “We have registered the case and arrested Yadav. He was produced before court and remanded to police custody,” another officer said.
