AIIMS Rape case: Cops clueless about sodomy law

Victim's father had to wait all day to get complaint registered at police station

Guru Dutt Sharma's ordeal hasn't ended yet. The east Delhi businessman, whose eight-year-old son was sodomised by a surgeon at one of the countries top medical institutes -- the All India Institute of Medical Sciences (AIIMS) -- is now running from pillar to post trying to get the police to file an FIR. Apparently, the cops didn't know under which act they should file the case.

Sharma was reportedly kept waiting at the Hauz Khas police station for seven to eight hours before he could file an FIR as the officers were confused under which criminal act they should file the case.

"I came here at 1.30 to file the FIR but they filed my complaint at 6.30 pm as they were not aware about what criminal act should be used," Sharma said. A senior police office finally lodged an FIR under section 377 (sodomy) and 506u00a0 (threatening) of IPC at Hauz Khas police station. Sharma is still in a state of shock as his only child was sodomised by a surgeon at AIIMS. The accused, Dr Shijoy, is a senior resident of the neurology department.

The victim, Gaurav, was suffering from brain tumour and was admitted to the hospital on January 18. After the operation, he was shifted to the Internal Care Unit (ICU), from where the doctor took him to his room and sexually abused him.

"On 23rd night, the doctor took him to his duty room. My son was too young to understand all this. He later confided in my wife and she was shocked to hear all this from an eight-year-old child," Sharma said.

The next day, Sharma went to the higher authorities in the hospital including Medical Superintendent, Deputy Director, Dean and Director. "They were all trying to save the doctor. I was made to run from one doctor to another. The medical superintendent along with the director has received my complaint. But they didn't inform the police and asked me not to inform the police either," he alleged.

u00a0According to highly placed sources at AIIMS, the hospital deliberately formed the committee to save the institute from any kind of negative publicity. "They should have immediately taken the matter to the police. It is clearly a criminal case. How can a team of doctors look after a criminal case? Civil enquiry should not be conducted in a criminal case," said a senior doctor on condition of anonymity.

"The institute was trying to destroy evidence and delay the case. Internally, there have been numerous cases of sexual harassment, but the only difference is that this one came into the limelight. Otherwise they usually bury the matter," said another doctor on condition of anonymity.

"I was not aware about the matter. He did not come to me and I am not the concerned person. He must have gone to additional medical superintendent," said Dr D K Sharma, Medical superintendent, AIIMS. The director of the institute, Dr R C Deka, was unavailable for comment.
