Hubby files kidnap case against wife for sending daughter to UK

The Sessions court has asked the Kothrud police to investigate a kidnapping complaint after a 61-year-old man last week filed a case against his wife alleging that she kidnapped their daughter and sent her to the United Kingdom (UK) for further studies without his consent.


Rajesh (name changed), a consultant with a Dubai-based software company, had filed a divorce case against his wife Veena (55) (name changed) in 2005 at the family court in the city, and since then the couple have been living separately. The couples’ son and daughter, however, have been staying with the mother.


“In 2005, after filing for divorce, the mother sent her daughter to a university in London to pursue an MBBS course, as her daughter did not get admission in India. Also, Veena’s father had provided the monetary help to secure admittance for his grand daughter,” said police inspector (crime) S B Navale.


He further said that Veena had sent her daughter to the UK, and she has been living there since seven years, as her son, too, was living in that country along with his wife. “It is quite surprising that Rajesh did not take any action against his wife, but only recently filed the case in the court at Shivajinagar, Pune, through his lawyer. He claims his wife sent his daughter to the UK without taking him into confidence. He is now alleging that it is an act of kidnapping,” said Navale.

The court sent the case to Kothrud police station, since the mother stays in that jurisdiction, and directed the police to investigate the case and submit a report to them.u00a0Navale added that while filing the case, the complainant attached some decisions of various courts in India, in which partially similar cases had stood in the court and in some cases, the court had given a verdict in the favour of complainants. The Kothrud police have initiated the investigation in this regard and decided to summon Veena to the police station to take her version in this case.u00a0

Navale, however, said that the charges of kidnapping (363 of the IPC) would be tough to prove in this case, as the incident took place in 2005 and the custody of the girl was with Veena and the main objection to the case is why the complainant took seven years to file a complaint?

“Since the court has directed us to investigate the case, we would summon Veena to the police station and would be taking her version. After the investigation is completed, we will send the report to the court. If court dismisses the case and asks for action to be taken against Rajesh for filing a false complaint, then a case will be lodged against him.

Another police officer, investigating the case, said that the charges would not be proved in this case and it will not hold water in the court, as the judge will dismiss the case straightaway. Despite several attempts to reach Veena, she was not unavailable for comment. Kothrud police stated that the couple has lodged several cases against each other in the past, and have been always at loggerheads. u00a0
