Bank sits on customer's complaint and sends men from recovery department to get her to pay up

Gomathi Sridhar (40), an MNC employee, lost a total of Rs 23,244.08 to online credit fraud on August 8 and August 23, 2009.

Moreover, despite knowledge of the fraud, Standard Chartered Bank continues to send her reminders and recovery department officials keep on asking her to pay the amount and the interest on her credit card. She has complained to Reserve Bank of India (RBI) regarding the same.

"Once I learnt about the illegal transactions, I immediately lodged a complaint with the bank's customer care (Complaint No 01BLGHQ923801 dated August 28, 2009)," said Gomathi.

"The bank informed me that they need 45 days time to fill the dispute declaration form. It's close to a year since that assurance. That entire circus and hundreds of calls have come to nothing. The bank is yet to make any progress on the matter."

Gomathi further added that representatives from the bank's recovery department still continue to harass her.
"I don't like them coming to my house for collection. On June 2, I lodged a complaint with the Reserve Bank's banking ombudsman," said Gomathi.

Sunil Mishra, associate manager, Standard Chartered Bank, said he would try to solve the problem at the earliest. "Let her come to our bank. We will try to solve the problem as soon as possible. I will also speak to the manager concerned and resolve the issue," said Mishra.

C V Giddappa, General Secretary of Credit Card Holders Association of India, said, "The bank has to provide justice to Gomathi. Moreover, when a complaint is pending with the banking ombudsman, the bank cannot hold back or deduct money from her account.

According to Sec 60 of Civil Procedure Code, when there is an attachment warrant, the bank can only hold 1/3rd of the income. Many software professionals have resigned from their jobs just because of the bank's attitude."
