Ace choreographer Shiamak Davar’s dance studio in Mahalaxmi is in a spot of bother. The Brihanmumbai Municipal Corporation’s (BMC) G-South ward issued a notice last month, asking him to demolish certain unauthorised partitions and cabins in Arch number 8, located beneath the Mahalaxmi bridge. If Davar fails to demolish them, he could be fined or imprisoned.

The notice
The notice, signed by Assistant Engineer of Building and Factory, G-South ward reads, “This office has issued the notice, under Section 351 of Mumbai Municipal Act, for unauthorised construction of partitions and cabins in Arch number 8, below Mahalaxmi bridge. You are hereby directed to remove the unauthorised construction of partitions and cabins. Failing which the same will be demolished by this office entirely at your risk and cost and prosecuted under Section 475 of MMC act.”

The notice further reads, “failing to demolish the unauthorised portions, the offence is punishable with an imprisonment for a term which shall not be less than one month but may extend to one year and with a fine that shall not be less than Rs 5,000 and may extend to Rs 25,000 and in case of continuous offence with a further daily fine which may extend to Rs 500.”
BMC says
Bhagyshree Kapase, ward officer of the G-South ward confirmed that a notice has been sent to Davar. She said, “We have issued notices to all the occupants beneath the Mahalaxmi bridge. We have asked them to demolish the illegal alterations carried out by the occupants in the arch. The bridge is almost 100-years-old and we have to carry out a structural audit of the same. The alterations will have to be removed. Even the commissioner has visited the site. Once I am back from my leave, I will be able to give a full report on the same.”
Notice to other galas
Many galas are located beneath the bridge, and the BMC has issued notices to several of them. “The notices have been issued to nearly 36 galas. We are serious about the alterations carried out by them,” Kapase added.
Bharat Gupta, one of Davar’s associates, did not revert with a comment.
