Woman blames police of going slow, court summons DCP

On March 24, a city court had asked the Delhi police to trace a missing girl within two days after her mother alleged that her estranged husband had taken her away. On Wednesday, the court summoned the District Commissioner of Police (West) before it to explain his department's failure.

Avaneet Kaur had alleged that her husband Ravinder Singh took the three-and-a-half-year-old girl away without her knowledge or consent on March 6 and has been absconding since then. Kaur married Singh in 2004 but the couple were living separately as Kaur claims she was facing harassment at her husband's home. In her plea, Kaur said she was forced to approach the court as the Nihal Vihar police station in northwest Delhi did not act on her complaint.

Metropolitan Magistrate Gaurav Rao issued the summons, seeking explanation on the progress in the probe following Kaur's application. "The police have not at all been cooperating in our matter. It's only after this summon that the police have shown some interest in the case. On Wednesday evening the police managed to secure a photograph of the child to identify her. The police called my husband's brother to interrogate him, but all of them are a party to it," Kaur said.

The application was filed through her counsel Deepak Kumar Sharma under Section 97 (search for persons wrongfully confined) of the Criminal Procedure Code. SHO Nihal Vihar police station, who appeared before the court on Wednesday, submitted that the police had issued a notice against Singh to join the investigation. Earlier the police had also claimed that a message had been sent to all district police headquarters to nab the man with the child.

The counsel also sought a direction from the court for the police to bring call detail records of the mobile phone of the accused as well as the investigating officer of the case. Sharma alleged, "It's been such a long time and the police are still not able to trace the child. So many days have already passed and the police are not taking the case seriously."

The court had earlier expressed its displeasure over the 'careless' manner of handling of such a 'sensitive' issue by the police. "Taking into consideration the age of the child, the kind of relation and maltreatment meted out to the mother and that the husband was not available at his residence, the act of the husband amounts to illegal confinement," the court said, issuing a search warrant.

The DCP (West) is to appear before the court on April 16.
