The BMC has issued a demolition order for razing down the illegal component of a housing society in Goregaon, whose builder allegedly sold its parking space to a school, without informing the residents.

On July 2, the BMC issued a notice to Daya-Sarita Cooperative Housing Society at Gokuldham, Goregaon (East) to demolish the illegal part.

The builder, Kiran Shah, who lives in the same society, sold the parking space to a woman, Kripa Singh, without any intimation to the society.

When Singh started running a pre-primary called Kinder Garden in the parking space last month, society members enquired into the matter only to find that Shah, who had taken the permit to open a bank in the parking space, sold the space for a school to come up.

In so doing, not only did he flout FSI norms by using up more space for the school, but also betrayed the trust of the occupants, residents said.

u00a0"We were shocked to see the school in our parking space. We are constantly disturbed by the noise of kids. The builder has flouted several norms. He never even contributed to the maintenance of the building despite living here," said Ravi Rochlani, secretary of the society.

The seven-storey tall Daya-Sarita building was constructed 17 years back, but was not registered. In 2008, society members managed to the registration but the builder succeeded in revoking it by withholding his consent.

He again threw in a spanner when the members attempted getting it the following year. Last year, they finally got the registration.

"The builder has encroached upon the parking space by breaching FSI norms. We are tired. The BMC has issued a demolition notice and another one under the MRTP Act," said Vinod Mhaskar, a society member.

The FSI rights are vested in the builder. After securing the sanction for a bank at the ground floor, he sold it so a school may come up.

"The BMC has issued a notice for demolition but discussion is on. I hope u00a0the matter is settled soon," said Kripa Singh, owner u00a0of the Kinder Garden u00a0u00a0school. Despite several attempts, builder Kiran Shah was u00a0not available for comment.
