AIIMS reports say he needs to be kept on a strict routine, along with medication
Rajya Sabha member Amar Singh, arrested for the 2008 cash-for-vote scam, will have to spend a few more days in judicial custody. The bail plea order of Singh was reserved by Delhi High Court on Wednesday till October 24 after the Centre said that medical reports suggest 'all is not well' with him.
Additional Solicitor General Mohan Parasaran told Justice Suresh Kait during the hearing they have seen the medical reports given by the All India Institute of Medical Sciences (AIIMS). "As they have come from a reputed institute, we cannot dispute them and the parameters show that all is not well," he said.
Silver lining
The court, after hearing detailed arguments, reserved the order for Monday. With the Delhi police counsel favouring the granting of conditional bail to him if certain conditions are fulfilled, the likelihood of bail being granted looks bright. Earlier on Tuesday, Justice Suresh Kait decided to hear Singh's interim as well as regular bail pleas after the state counsel sought an adjournment due to non-availability of its senior advocate to advance arguments on its behalf. Appearing for Singh, senior advocate DC Mathur argued, "The provisions for bail provide that a sick and infirm person can be granted bail on this ground alone and if Amar Singh's case is not covered under it, then what will be termed as sickness?"
Multiple problems
"It is an admitted case that Singh is living on a donated kidney, transplanted in Singapore, and the surgeon, who did the surgery, is supposed to take care of the patient after the transplant. Unfortunately, the lower court did not consider it and termed his condition as stable," Mathur contested. Police counsel said, "We cannot dispute the report of AIIMS, which states his condition is critical. Therefore, we do not oppose his bail
application, on medical grounds."
The All India Institute of Medical Sciences (AIIMS), where Singh is admitted, had submitted his medical report in the court on October 12, saying he needs constant medical monitoring. Justice Ajit Bharihoke, who retired last week, had then adjourned the matter till October 18. The court accepted the report but said that it needed time to go through it.
