In a major reprieve to 'encounter specialist' Daya Nayak, a special court today accepted the closure report filed by the ACB against him in a disproportionate assets case. Special ACB court judge Dilip Gudadhe accepted the anti-graft agency's closure report.
"We had filed a closure report recently and the court accepted it," an Anti-Corruption Bureau (ACB) official said, adding that they were waiting for the copy of the order. In the closure report, it has been mentioned that his known sources of income are less than 10 per cent (of his known sources of income), the official said. "If the assets disproportionate to the known sources of income are 10 per cent or less than that, then no case is made against the accused," he said.
In 2010, the ACB had filed a closure report in the same case. However, the court had rejected it then. Sub-inspector Nayak, who is credited with over 80 encounters, was suspended in 2006 following an ACB probe. The ACB had claimed that Nayak owned an 800 sq ft flat in Charkop in suburban Mumbai, a jeep, a finance company, and he had also invested Rs 1 crore in the construction of a school in his native village in Mangalore, apart from laundering money through bogus companies. He was arrested on February 20, 2006, and was in police custody and later in judicial custody for 59 days. He was granted bail on April 20, 2006.
Former DGP SS Virk had refused to give sanction to the ACB for prosecuting Nayak in the disproportionate assets case. The DGP, in his order, had said that the grounds for prosecuting Nayak in the case were insufficient. He had, however, made it clear that a departmental inquiry can be initiated against Nayak as per the findings of the ACB probe. The controversial officer was reinstated into the Maharashtra Police force in 2016.
