A man was arrested in Hyderabad for allegedly sexually assaulting a minor girl, police said on Wednesday.

Based on a complaint filed by the girl's family members, a case was registered against the accused, who hails from Uttar Pradesh, under relevant sections of the Protection of Children from Sexual Offences (POCSO) Act, police told news agency PTI.

The accused, who is in his mid-20s, was arrested on Monday and remanded to judicial custody, an official from KPHB Police Station said.

Observing that cases under the Protection of Children from Sexual Offences (POCSO) Act require "utmost caution", the Delhi High Court (HC) on Wednesday cancelled the bail granted to a female teacher in connection with the alleged rape of a three-year-old girl by a staff member inside a private school in west Delhi's Janakpuri area, news agency PTI reported.

The court directed the teacher to surrender within three days.

On June 29, HC had also set aside the bail granted to the main accused, the caretaker of the school, in the case registered under the POCSO Act and directed him to surrender on July 1.

In his order, Justice Saurabh Banerjee observed that while deciding bail applications in cases involving sexual offences, "essential surrounding factors" such as the physical, emotional, mental, and psychological harm suffered by the victim must be given due weightage.

The court allowed the Delhi Police's plea challenging the trial court order that granted bail to the teacher on May 20.

"The respondent is hereby directed to surrender before the jurisdictional Additional Sessions Judge (POCSO Court) within three days of this judgment at or before 12:000 Noon," Justice Banerjee said.

The teacher was arrested for allegedly concealing the incident from authorities and was remanded to one-day police custody by the trial court on May 14.

In the judgment, Justice Banerjee observed that the trial court had wrongly granted relief to the teacher merely because the survivor had not disclosed her name in the complaint.

The judge emphasised that a three-year-old child cannot be expected to reveal every detail while making an initial complaint. He said the trial court erred by completely ignoring the crucial fact that the survivor had not only identified the teacher in the presence of her mother but also identified the spot where the incident allegedly took place.

"Strangely, and though there is no bar, the learned Trial Court proceeded to grant regular bail to the respondent barely within six days of her arrest, when a bare perusal of the impugned order does not reflect anything which could/ may have prompted it to do so," the court stated.
