Leader of the Opposition in the Lok Sabha, Rahul Gandhi has approached the Supreme Court challenging orders passed by the Allahabad High Court in a case involving allegations of disproportionate assets levelled against him by Karnataka-based BJP worker S Vignesh Shishir.
A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V Mohana is scheduled to hear Gandhi's plea on August 17.
The case relates to a complaint filed by Shishir alleging that Gandhi possessed assets beyond his known sources of income.
In May, the Allahabad High Court had directed the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) to examine and verify the allegations and keep the court informed about the progress of the matter.
Gandhi has now challenged those directions before the apex court, questioning the process initiated on the basis of the complaint.
Gandhi has also separately sought the transfer of the proceedings from the Allahabad High Court to the Delhi High Court.
The challenge comes as the High Court continues to monitor the progress of the inquiry into the allegations.
During its hearing on July 20, the Allahabad High Court found the affidavit submitted by the CBI unsatisfactory.
The court subsequently directed the agency to submit a fresh affidavit providing details about the status and progress of its inquiry into the allegations.
The High Court had also taken note of the steps undertaken by the Enforcement Directorate (ED) in the matter.
The High Court observed that the Enforcement Directorate (ED) had taken the steps required of it at that stage.
The court also clarified that the agency would remain free to initiate appropriate legal proceedings if its investigation produced actionable information.
The matter before the Allahabad High Court has been listed for further hearing on August 20.
Meanwhile, Gandhi's challenge to the High Court's directions will come up before the Supreme Court on August 17, where the apex court will consider his plea and his challenge to the proceedings arising from the allegations.
