A court in Maharashtra&rsquo;s <a href="https://www.mid-day.com/mumbai/mumbai-crime-news/article/thane-drug-bust-mephedrone-worth-rs-6-68-lakh-rs-20-76-lakh-cash-seized-four-arrested-23645894" target="_blank" rel="nofollow noopener">Thane district</a> has sentenced two brothers to two months of simple imprisonment for assaulting a traffic police constable during a vehicle seizure operation in 2019.
Additional Sessions Judge D B Mane convicted the two accused under relevant provisions of the Indian Penal Code and also imposed a fine of Rs 5,000 each.
<h2>Brothers convicted in assault case</h2>
The convicted brothers have been identified as Afnan Afak Qureshi, 25, and Tamshil Qureshi, 29.
The case dates back to August 19, 2019, when traffic constable Angad Murlidhar Munde was carrying out a vehicle seizure drive in Tanwar Nagar in <a href="https://www.mid-day.com/mumbai/mumbai-news/article/maharashtra-plaster-falls-from-30-year-old-mumbra-building-in-thane-structure-declared-dangerous-23645407" target="_blank" rel="nofollow noopener">Mumbra</a>.
Police had impounded motorcycles being ridden by underage riders during the operation.
<h2>Argument over seized motorcycles</h2>
According to the prosecution, the seized motorcycles were taken to the <a href="https://www.mid-day.com/mumbai/mumbai-news/article/maharashtra-panvel-police-book-municipal-sanitation-worker-for-making-obscene-gestures-towards-10-year-old-girl-23643380" target="_blank" rel="nofollow noopener">Mumbra Traffic Branch.</a>
An argument reportedly broke out after the accused demanded that the vehicles be released immediately without paying the required fines.
The situation allegedly escalated, with the two brothers grabbing the constable and dragging him towards a road divider.
The constable was allegedly knocked down during the incident and suffered injuries.
While delivering its verdict, the court noted that a video recording of the incident captured on a mobile phone clearly established the sequence of events.
The court observed that the electronic evidence supported and corroborated the statements provided by the complainant and eyewitnesses.
The footage therefore played an important role in establishing the prosecution&rsquo;s case against the two brothers.
<h2>Two co-accused acquitted after court relies on video evidence</h2>
The court, however, acquitted co-accused Shamsuddin Bangi and Khairunissa Shaikh.
The two were given the benefit of acquittal because the prosecution failed to establish specific overt acts attributable to them in connection with the assault.
Court imposes jail term and fine
Following their conviction, Afnan and Tamshil were sentenced to two months of simple imprisonment.
