The Chief Metropolitan Magistrate Court has disposed off Shyamvar Rai&rsquo;s application, to tell &lsquo;the truth&rsquo; before the court in the Sheena Bora murder case, without recording his statement. Rai was the former driver of Indrani Mukerjea, co-founder of INX Media, and main suspect in the Sheena Bora case.

A CBI official on Saturday said, &ldquo;The Magistrate has disposed off Rai&rsquo;s application by stating that proper procedure was not followed while filing the same.&rdquo; On October 19, Rai had submitted a one-page letter, written in Hindi, to the court stating that he wanted to reveal the &lsquo;true facts of the case.&rsquo;
On Monday, he was presented in front of the Magistrate. However, the hearing was postponed to Tuesday, when the court noted that proper procedure was not followed. Meanwhile, the judicial custody of Rai, Mukerjea and her former husband Sanjeev Khanna was extended till November 7 after their earlier remand ended.

This was the first time all three accused were produced before the court after the CBI took over the investigation last month. Magistrate N B Shinde gave CBI permission to interrogate the trio, however, he stated that Mukerjea could be questioned only after the medical officer issues her a fitness certificate.
Mukerjea, who was present in court on Saturday appeared too weak and was seen lying down on the court bench most of the time. Her advocate, Gunjan Mangla, told the magistrate that Mukerjea was palpitating and was too weak to take the witness stand.
Addressing CBI&rsquo;s application to collect Mukerjea&rsquo;s voice sample, the court asked Mangla to take Mukerjea&rsquo;s consent before collecting the same. The court has given her time till Tuesday for the same.
