Percept wins the legal EDM battle

Percept wins the legal EDM battle

The Electronic Dance Music (EDM) scene took an ugly turn this year when DJ/VJ Nikhil Chinapa ended his partnership with Percept Limited, with which he had founded popular EDM festival, Sunburn.

The drama went up a notch when Chinapa joined hands with Live Viacom18 and announced a new festival Candolim Beach, Goa the same venue where Sunburn is held every year. Percept even filed a suit against Viacom18 for stealing trade secrets, the results for which were announced in Percept’s favour on Monday.

Harindra Singh, vice chairman and managing director of Percept informed us that they first got to know of leak of data when members of the State Level Permission Committee (SLPC) mentioned that the accused company had used the same presentations that are being used by Percept for years, to seek permissions for their festival.

Fresh applications
Things looked good for Supersonic, the new festival, when they announced to the media that they had received all the required permissions to hold the festival at Candolim Beach. But according to the notice issued by the Bombay High Court on September 9, Viacom18 will now have to file fresh applications for holding the festival, without using the literary and artistic work originally created by Percept.

These applications filed by Viacom18 will be considered by the SLPC within a period of four days from the date of receipt. It will then be a race against time as the dates of Supersonic have been announced as December 26 to 30. “A lot of programming, research and development, visiting and learning from international festivals goes into coming up with a festival and obtaining all the required permissions.

I am happy that it has finally been acknowledged that all the presentations, down to minute details, were stolen, as were our hardwork. Though they have been given the permission to reapply,” says Singh. When contacted, Viacom18 Company spokesperson told us, “The Vh1 Supersonic Festival will go on as planned.” Though it has been announced that Sunburn will now be held at Vagator Beach this December, the companies are also fighting in the court over Candolim beach as the venue.u00a0
