Dismissed RPF constable Chetan Singh Chaudhary, who allegedly shot dead four people -- including three passengers and an RPF Assistant Sub-Inspector -- in a moving train in July 2023, has applied for bail in the Mumbai sessions court.

The bail application was filed by his lawyers, Adv Amit Mishra and Adv Pankaj Ghildiyal, on Monday citing that he suffers from “white matter disease” and a “delusional disorder.”

The hearing on Chaudhary's bail application is scheduled for December 8.

The plea claimed that he has no recollection of the incident due to his medical condition. “White matter disease” refers to damage or degeneration of the brain’s white matter.

“The accused is suffering from extreme mental episodes and is a partial mental patient who sometimes becomes whimsical and enters a loop of illusions. He suffers from delusional disorder,” the plea stated.

It said that that Chaudhary had no awareness of the crime when it occurred.

The bail application also noted that custodial interrogation is unnecessary as the chargesheet in the case has already been filed.

It further states the applicant has been mentally unstable and was under the supervision and control of Thane Mental Hospital for a period of four months.

The plea emphasises that he is not required for any further investigation.

The accused reportedly suffers from extreme mental conditions, including delusional disorder, and was not aware of the crime at the time.

It also mentions that Chaudhary experience illusions and whimsical thoughts, which may have influenced his actions during the incident.

In December 2023, a similar bail plea filed by Chaudhary had been rejected.

The latest application comes at a time when the court is recording witness testimonies.

Chaudhary is accused in the Mumbai train firing case. He had allegedly opened fire inside the moving Jaipur-Mumbai Central Express near Palghar railway station in Maharashtra on July 31, 2023.

He was booked by the police and later apprehended with his weapon while allegedly attempting to flee, after passengers pulled the train’s emergency chain, bringing it to a halt near Mira Road station on the Mumbai suburban train network.
