Though externment proceedings had not even commenced, Mariappa apprehended that they would, shortly before voting day. After much convincing, a bench comprising justices VM Kanade and PD Kode agreed to allow him to stay in Mumbai long enough to be able to exercise his franchise. Appearing on behalf of the petitioner, Advocate Jyoti Chavan said, "The petitioner is my daughter-in-law. Please put a stay on the externment proceedings at least until after the elections. I am approaching the court at this stage because if they extern me before voting day, my efforts will be in vain." Put on notice On February 6, Mariappa received a show cause notice and another supplementary notice two days later, seeking to extern him from the Mumbai and Mumbai suburban area. Mariappa applied to the ACP of Santacruz Police station, requesting a week's delay, which was rejected. The notices mention ten cases, which Mariappa is charged with. The accused says he has been acquitted in seven. Mariappa had received a similar notice in March 2009 for the same offences, but the authorities later cancelled the proposal. According to the petition, the externment proceedings are politically motivated.
