Actor Irrfan Khan has approached the Bombay High Court in a case pertaining to unauthorised alterations under the MRTP Act, 1966, in his flat, citing relief given to comedian Kapil Sharma in a similar case.
The BMC had, on April 28, 2016, served notice under 53 (1) of the Maharashtra Regional and Town Planning Act, 1966 to Kapil Sharma, builder Dev Land and Housing Private Ltd and Irrfan Khan for alleged irregular constructions inside their flats in DLH Enclave, New Link Road, Goregoan. Sharma had approached the High Court claiming that the building had been constructed as per the sanctioned plan and the BMC had issued an occupation certificate too. Sharma had also asked for and was granted a stay on the BMC notice till the matter was heard. The court had kept the matter for hearing for November 23, and Khan approached the court yesterday, seeking relief.&nbsp;Trouble for Khan started after Sharma tweeted in August about corruption in the civic body.&nbsp;Stung, the BMC started gathering evidence against Sharma&rsquo;s unauthorised changes at his office in Oshiwara and residence at Goregaon. An FIR was registered by BMC&rsquo;s Sub-Engineer P South Ward Abhay Jagtap under section 53 (7) of the MRTP Act that deals with prosecuting flat owners for not following up with notices against unauthorised constructions.&nbsp;The BMC claims that the alterations were contrary to the OC issued by P South ward office in November 2013. Sharma had been booked earlier for destroying mangroves and unauthorised construction near his bungalow in Versova.
The bench of justice Naresh Patil and justice Makarand Karnik had scheduled the matter for hearing today.
