The Bombay High Court yesterday rejected the intervention application filed by 2002 gang rape victim Bilkis Bano. She wanted to be heard by the court after seven of the convicted accused filed for an appeal.
Justices Vijaya Tahilramani and Mrudula Bhatkar had asked her to file an appeal under Section 372 of the Criminal Procedure Code (CrPC), but she filed an intervention application under Section 482 instead.
The court said they would hear her out only on the acquittal of seven of the accused, but not on the appeal filed by those convicted.
Flashback On March 3, 2002, in the aftermath of the Godhra riots, a mob had attacked Bilkis family in Randhikpur, around 250 km from Ahmedabad. The mob had killed eight of her family members &mdash; four women and four children &mdash; while six others went missing.
The Supreme Court transferred the case to Mumbai after observing that the witness would be vulnerable to danger in Gujarat. Sessions Court judge UD Salvi, in January 2008, sentenced 11 people to life imprisonment, while a constable was sentenced to three years for refusing to register Bilkis&rsquo; rape case. Seven people were acquitted.
