Khar hammer incident: FIR filed only after Mid-Day report

The Khar police have registered an FIR against an unknown person after an iron hammer head allegedly fell from the 11th floor of the under-construction Maya Apartments on 15th Road in Khar West on November 9. The incident left dentist Aksha Tholiya seriously injured after the iron chunk struck and grazed her head. Police are now trying to identify who was responsible.

The Tholiya family struggled for nearly a week to get the FIR registered, but the Khar police did not file a case until mid-day reported the incident. Following the report, the police on Monday called the victim and registered the FIR. mid-day, on November 17, reported how the hammer head fell from the building and injured Tholiya, who was admitted to Hinduja Hospital. She received stitches on her head and suffered a jaw injury before being discharged.



On Monday, Khar police registered the FIR under Sections 125A and 3(5) of the Bharatiya Nyaya Sanhita for negligence causing injury to Tholiya. According to police, the incident occurred when Tholiya had visited the Parshwanath Digambar Jain Mandir  on 15th Road with her friends.

Describing the incident, Tholiya said, “I had just stepped out of the temple after doing pooja and was standing outside with Jain munis. Suddenly, something hit my head and I collapsed. My friends rushed me to Hinduja Hospital, where I received stitches and treatment for jaw injuries.” Her father, Alok Tholiya, said, “We are thankful that the police have finally registered an FIR. The case is against an unknown person for negligence.

The culprit must be arrested.” A police officer added, “We have registered an FIR after the hammer head fell on the dentist. We are identifying the person responsible.”
