The second accused in the case involving murder of a 19-year-old student has claimed innocence and filed a bail plea in the sessions court on Monday. Shree Jogdhankar has claimed that his injuries were caused when some people at the New Year’s Eve party attacked him, and that he was being framed by the police. Earlier, Diya Padalkar had said that she was wrongly accused in the case, and applied for bail. The court will hear Jogdhankar’s bail plea on February 17, along with Padalkar’s application.

Jogdhankar’s bail application filed by his lawyer Mahesh Vaswani, stated, “At the party, some people attacked him and he got hurt badly. He left Bhagwati Heights, as per the CCTV footage, with grievous injuries, and some of his friends took him to Sion hospital where he received stitches. He received a phone call from Yash Bihari Ahuja that Jhanavi was injured and admitted to Bhabha Hospital... and he rushed there, and later to Khar police station.”

None of the 15 people present at the party, or the security guard or other members of the society, is a witness against him in the case, he stated in the application. “This is a cooked-up story with a motive to shield the real culprits. There is no cogent material to substantiate the allegations of murder, as there is not even one eyewitness...”

“Even if police allegations are taken at face value for the sake of argument, without him admitting the same, at worst it could be a case of culpable homicide not amounting to murder, and not a case of murder as alleged by the police. The incident is clearly alleged to have happened at the spur of moment and is of a personal nature,” the bail plea added.

On Monday, Jhanavi's mother, Niddhi Kukreja along with social activist Asif Bhamla met Joint Commissioner (law and order) Vishwas Nangre Patil, where the family was informed that the special public prosecutor, ADV Pradeep Gharat has been appointed for the case and the investigation is on track.
