Manikpur police have registered a non-cognisable offence against one of their constables for the alleged assault of a Vasai restaurateur.

According to the police complaint, Nitin Nalawade, a Manikpur police constable, and a friend had drinks at Hotel Trupti Family Restaurant and Bar at Ambadi Road in Vasai East on Wednesday night. But when the bill &mdash; of Rs 458 &mdash; arrived, a smug Nalawade allegedly refused to pay up and abused the waiter. When the restaurateur, Takshil Nagraaj Shetty, was called in, he too, was allegedly abused.

The complaint says Shetty then tried to prevent Nalawade from riding away on his motorcycle, but the constable ran over his foot and took off. &ldquo;I tried to stop him, but he abused and assaulted me, and ran his motorcycle over my feet,&rdquo; Shetty complained.

Shetty immediately called his father, who took the restaurateur to the Manikpur police station. &ldquo;We complained about the high-handedness to the duty officer. Our statements were recorded and a case was registered against Nalawade,&rdquo; he said.

Shetty said the assaults have been caught on the restaurant&rsquo;s CCTV cameras.
Shrikrishna Kokate, additional superintendent of police, Palghar, said a case treating the offence as non-cognisable has been filed under Sections 323 (voluntarily causing hurt) 504 (intentional insult with the intent to provoke breach of peace) and 506 (criminal intimidation) of the IPC against Nalawade.
A non-cognisable offence needs a court order for an arrest.
