The Bombay High Court has asked the Maharashtra Government to file within two weeks its reply to a PIL seeking a CBI probe into the alleged suicide of a 27-year-old man whose body was found on railway tracks in suburban Mulund on March 21, 2010.
Kapil Patil, the deceased, worked with a multinational company.
According to the petitioner Ketan Tirodkar, a senior police officer had tried to frame him up in a false case.
Patil, who helped underprivileged children with education, had come to know about a senior police inspector in Mulund allegedly having an affair with a young girl. Patil persuaded the girl to pursue education and her career, and the girl stopped seeing the officer.
Afterwards Patil was picked up by police and charged in a false case, before getting bail, according to Tirodkar. However, he was picked up again, and finally, on March 21, 2010, his body was found on the tracks.
Patil had no criminal antecedents and hailed from a well-educated family, with his father being a bank employee, according to Tirodkar.
Police station diary had a noting as "escape from custody" about his disappearance, but no wireless message was ever sent to other stations in the meantime.
The state government had ordered a CID inquiry, but it did not yield any result, the PIL said, praying for a CBI probe.
On Friday, the division bench headed by Justice P V Hardas sought a reply from the state in two weeks.
