Singer Kailash Kher on Wednesday approached the Bombay high court after the Mumbai Police refused to register an offence of cheating against three people, who allegedly duped him.
The Bollywood and Sufi singer was promised three offices in a society at Juhu-Versova Link Road for Rs 3.15 crores. However, Kher later learnt that a nationalised bank had sealed all the three offices as the accused, who had mortgaged the property, had failed to return the money to the bank.
Treating Kher's complaint as serious, the Bombay high court bench of Justices Naresh Patil and Prakash Deu Naik directed the DN Nagar police to register an offence on Kher's complaint and start investigating the matter on an urgent basis.
Senior counsel Ashok Saraogi, who appeared for Kher informed the bench that in December, 2015, Kher was shown three offices &mdash; 401, 402 and 403 &mdash; in Jai Ambe Society. Since Kher liked the property, he decided to invest into the said flats. The price of three offices was fixed at R3.15 crores and the singer also made an initial payment of Rs 1.51 crores.
However, he was later told that Dena Bank had sealed all the three offices. After some inquiries, he learnt that Vijay Kumar Singh, Anand Kishore Chaudhari and Bard Pinto from whom he had bought the three offices had mortgaged the said property to Dena Bank and had failed to pay the money. The bank then sealed the property.
Feeling cheated, Kher then approached the DN Nagar police station. However, the police officials did not register an offence in the matter. The singer then decided to approach the Bombay high court.
GP Mulekar, assistant public pleader, who was representing the state, told the bench that Kher&rsquo;s manager had visited the police station several times and that the cops had asked him to bring Kher along to register the FIR.
The bench, while expressing its displeasure at the shoddy manner in which the cops had handled the case, has asked the police to take action immediately. "Kher will visit DN Nagar police station between 10 and 12 am on Thursday and register the FIR," Kher&rsquo;s counsel Saraogi informed.
