Thane court acquits 2 brothers of attempted murder charges citing insufficient evidence

Thane court recently acquitted two brothers; the judgement highlighted the lack of conclusive evidence and inconsistencies in witness testimonies.

Thane court recently acquitted two brothers from charges of attempting to murder a man in 2018. The judgement was delivered by Additional Sessions Judge A S Bhagwat on January 17 but was made available on Sunday, per PTI report. 


According to the report, the judgement highlighted the lack of conclusive evidence and inconsistencies in witness testimonies.


The prosecution said that Yogesh Deepak Vaity (32) and his brother Jayesh Deepak Vaity (37) attacked a guy with a knife at a gas pump in Thane's Kashimira neighbourhood on June 12, 2018, with the intent to kill.


However, the defence claimed that the brothers were wrongly charged and had no involvement in the purported crime. The trial found that the complainant and other prosecution witnesses did not present consistent and convincing versions of the occurrence.

After careful consideration, Judge Bhagwat concluded that the prosecution could not prove the brothers' guilt beyond a reasonable doubt. The judge gave the accused the benefit of the doubt, citing contradictions in statements and a lack of supporting evidence.

Meanwhile, in another incident, Palghar cops filed a murder case after finding a dead body with injury marks outside a railway station. 

According to a PTI report, the police in Palghar district's Naigaon found a body with injury marks outside Naigaon railway station and suspecting it to be a case of murder, filed a report. Reportedly, the deceased was aged 40. 

The cops told PTI that some passers-by spotted the dead body near a toilet close to Naigaon railway station on Sunday evening and told the police. The inspector from Naigaon police station, Mangesh Andhare, further told PTI that they rushed to the spot once they were notified. Upon reaching the spot, they conducted their preliminary examination and then sent the body to a government hospital for post-mortem.

Reportedly, the deceased was identified as one Bhagoji Uttekar. The autopsy report is awaited, the official said. 

According to the report, the Naigaon cops have filed a case against unidentified assailant under Section 302 (murder) of the Indian Penal Code and are conducting probe into the case.
