New Delhi: Delhi Police today filed in a court here its charge sheet against a driver of US-based cab service provider Uber, 19 days after he allegedly raped a 27-year-old woman executive.
The charge sheet was filed against 32-year-old Shiv Kumar Yadav for the alleged offences punishable under sections 376 (rape), 366 (kidnapping or abducting woman with an intent to compel her for marriage), 506 (criminal intimidation) and 323 (voluntarily causing hurt) of IPC.
Metropolitan Magistrate Ajay Kumar Malik fixed the over 100-page charge sheet for consideration on January 2 and also extended the judicial custody of the driver till then.
The investigating officer told the court that the police have cited 44 prosecution witnesses in support of their case. The police said that they have relied on the forensic evidence and also placed on record the route map of the car in which the offence was committed.
According to the police, the ordeal took place during the two-and-a-half hours she had to spend in the cab after being picked up by the driver.
Yadav was produced before the magistrate with his face covered after expiry of his 13-day judicial custody. His wife was also present during the hearing.
Yadav, who was driving the cab, had allegedly raped the woman on the night of December 5 when the victim, who works for a finance company in Gurgaon, was headed back to her home in north Delhi's Inderlok area.
He was arrested on December 7 from Mathura in a joint operation by Delhi and Uttar Pradesh Police and produced before the court on December 8.
Earlier, the police had told the court that during Yadav's custodial interrogation, they have recovered mobile phones and clothes, which he was wearing at the time of the offence.
Yadav had refused to undergo Test Identification Parade (TIP), saying the woman had already seen his photograph in Uber's website and she would definitely identify him.
TIP is a process under the criminal law through which a victim identifies an accused. During the last hearing, the court has asked volley of questions from the investigating officer, including if the statement of the victim had been recorded before a magistrate&nbsp;and whether the accused has undergone TIP.
On being asked by the court as to whether Yadav's driving licence was genuine or fake and when was he hired by the cab provider company, the police had said his licence has been found to be fake and he was employed by the firm a month ago. The police had also told the court that Yadav was hired by Uber and it had not verified his particulars and they have lodged a case of cheating against the firm.
Yadav, along with Javneet Singh, is also lodged under judicial custody in connection with a separate forgery case recently lodged against him.
Singh was alleged to be a tout who had purportedly assisted Yadav in procuring fake character certificate.
According to the police, Yadav had got All India Tourist Permit after submitting the character certificate to the State Transport Authority in Burari here.
It had said Singh had taken Rs 2,000 from Yadav and had forged the character certificate on the seal of the Delhi Police and got it attested from a notary.
The police had said Yadav had told the investigators that he had procured the fake character certificate issued in the name of an Additional DCP of Delhi Police through an agent of a finance company.
