A court in Maharashtra's Nanded on Friday sentenced a man to life imprisonment after convicting him for raping a four-year-old girl and causing grievous injuries, news agency PTI reported.
The Principal District and Sessions Court Judge, Sunil Vedpatak, while stating the order, also imposed a fine of Rs 50,500 on the convict, Madhav Ramesh Janole.
As per the information presented to the court, “The child was playing outside her home when Janole lured her into his house under the pretext of giving her money for chocolate. He then proceeded to subject her to brutal sexual assault, causing serious injury."
Earlier, the Airport Police had booked the accused under the Indian Penal Code for rape as well as under the provisions of the Protection of Children from Sexual Offences (POCSO) Act, PTI reported.
Judge Vedpatak convicted the accused, upholding the decision that the prosecution had proved the charges against him, and handed him life imprisonment.
Thane Court acquits man accused of attacking mother, cites mental health condition
A court in Maharashtra's Thane district has acquitted a man who was accused of attacking his 80-year-old mother with a knife, PTI reported. The court, while passing the order, stated that the accused has mental health issues and directed his treatment.
Principal District and Sessions Judge SB Agrawal also pulled up the police for arresting the cognitively challenged man.
According to the papers submitted in the court, “The 55-year-old man attacked his mother, with a knife at their home in Thane district in October 2019. The accused then locked his parents and allegedly disposed of the weapon and his blood-stained clothes."
“The police arrested Shaikh for attempted murder, wrongful confinement and destruction of evidence,” the report added.
After hearing the matter, the judge said that it is clear that the accused was not of "sound mental condition".
He further highlighted that the man has had a history of mental health issues since he was in Class 12.
Judge Agrawal further emphasised, “Shaikh's conviction in a murder case was set aside by the Bombay High Court under Section 84 of the Indian Penal Code and slammed the police for failing to act on the obvious defence,” as cited by news agency PTI.
“As per Section 84 of the IPC, an act is not an offence if it is committed by a person with an unsound mind.
The court also ordered Shaikh's post-acquittal examination at Thane mental hospital and subsequent treatment,” the order stated
