Large number of angry homebuyers, who had invested their life savings in the Adhiraj Samyana and Capital City project at Navi Mumbai, gathered at Kharghar Police Station on Thursday to get a register a case filed against the developers for alleged fraud and cheating. However, they had to walk away disappointed after the police delayed the first information report (FIR), promising action only by November 4.
The buyers, many of whom have been waiting over a decade for their flats, said they are "mentally, emotionally, and financially exhausted" after years of false assurances from Adhiraj Developers.
"We came here to register an FIR against Adhiraj Developers, but even after hours of waiting, the police only took our statement. Senior Police Inspector Ajay Kamble told us that the builder will be approached on November 3, and if he fails to respond, the FIR will be filed on November 4. He assured that us we will get justice but we have heard enough assurances already," said Ashish Kumar, one of the buyers.
Adhiraj Samyana and Capital City was launched as a luxury township with multiple 55-storey towers at Kharghar. Buyers were promised possession as early as 2017-18, but the construction has been stalled since 2019.
For many, the wait has been excruciating.
Dr Vashisht Mishra, a senior citizen and one of the earliest buyers, said, "It's been almost 15 years. The owners and their representatives have stopped cooperating. The police should have filed the FIR immediately instead of pushing it to November 4. Anyway, we have waited so long, so what's another five days, but this delay is truly painful."
Another buyer, Rajiv Jha, who booked a 2BHK flat in 2015, said he was promised possession in 2018.
"When I went to their office in 2018, they said it would be ready in 2019. Then the project got stalled and now it's 2025 and we're still standing outside police stations instead of our own homes," Jha said bitterly.
For 68-year-old Emmanuel Philip, the ordeal has been heartbreaking.
"I put my hard-earned Rs 70 lakh into this 3BHK flat in 2015, thinking I would spend my retirement years there. I am now staying at a rented place paying Rs 22,000 as a monthly rent and my EMI is Rs 47,000 monthly. Now, at 68, I can't keep roaming around Adhiraj's office and police stations for justice. It's humiliating," he said.
Speaking on the police action, Kamble said, "We have received the buyers' complaint and will act. We will call the owners of Adhiraj Developers for questioning on November 3. If they fail to respond, we will register an FIR on November 4. The buyers will get justice."
However, the flat buyers were not convinced. Many said they will not remain silent anymore and will intensify their agitation if the FIR is not filed next week.
"Enough is enough. We will not sit quietly this time. If the police don't act, then we will ensure our voices are heard louder," said another buyer.
The buyers have already approached the Economic Offences Wing (EOW), alleging large-scale financial fraud, diversion of funds, and violation of RERA norms. The EOW complaint names the company's promoters Kunj Bihari Gupta, Brij Bhushan Gupta, and Nikunj Gupta among others.
Documents submitted by the buyers show that despite collecting crores from hundreds of families and securing MahaRERA registration, construction came to a halt in 2019. Many buyers continue to pay EMIs and rent simultaneously, as their dream homes remain unfinished skeletons.
"We will wait till November 4 but this time, we want results, not promises," said Dr Mishra firmly, as dozens of homebuyers walked out of the police station in frustration and despair.
