Our society had passed a resolution to erect a mobile company tower in the society. Initially, only one tower was approved but today four towers are in the process of being erected without any consent or permission.u00a0 What action can I take?u00a0- M Rohra
You are advised to write letters to the municipal authorities as well as the society highlighting issues of radiation, nuisance. If possible highlight on the above said fact with flat occupiers on the upper floor as well as senior citizens.

In spite of the same if you feel the managing committee wishes to proceed with the installation then you have to approach the court of competent jurisdiction, which is the co-operative court. I may add that if the towers have been installed then it will be difficult for you to get the same removed.

As per the provisions of the Maharashtra Co-operative Societies Act, first and foremost a society has to appoint a returning officer.
The returning officer will publish the election programme. Thereafter, the members desirous of contesting the election will submit the necessary papers to the returning officer. If there are more candidates than the number of seats then elections will be held.

In most of the cases, voting has to be done by ballot. If the number of candidates is less than the number of seats then the returning officer will declare the eligible candidates as having been elected.
In the event the number of candidates are less than the seats for which elections are held than the general body may fill up the vacancy.
I laminated my share-certificate of our society, as it was a bit torn. I would like to know if any name is to be added on it and how can it be done. I cannot remove the lamination as it may tear the share certificate. Requesting your advice. - A B Latkar
It is observed that at times persons laminate the share certificate. Once the lamination is done, it is difficult to make entries on the same.
In such cases you are advised to surrender the original share certificate and request the society to issue a duplicate share certificate on which the necessary changes like addition of associate members name can be done.

I am a member of a co-operative society. Recently, the society has installed a flash light above my bedroom window because of which a lot of mosquitoes and other insects enter my house. We requested the society to change the position but they are not ready to move the same. -Harit Desai
I would suggest to you to write a letter to the society and take up the issue with the managing committee.
You may request them to call a managing committee meeting. You may also explain that the problem canu00a0 easily be sorted out if the direction or the place where the light is installed is changed.
If the managing committee is adamant then you have a right to take the signature of one fifth of the members and insist for calling a special general body meeting.
