While couple is on verge of separation, lawsuit filed against them in 2007 for hurting religious sentiments still remains

Amid reports of actress Elizabeth Hurley and businessman Arun Nayar's separation, there is a court case pending against the two in Jodhpur.

The case was filed against them at the Jodhpur Metropolitan Magistrate court on March 13, 2007, soon after their royal wedding in Jodhpur in 2007.

They are said to have hurt the religious sentiments of Hindus during their wedding.

Vishnu Khandelwal, a Jodhpur resident, had filed the case against the couple in 2007 stating that they had deliberately insulted Hindu religion during their marriage.

There are three witnesses who have been examined in the case, but the case still needs an approval from the state to proceed further. If the prosecutors get the required permission, Hurley and Nayar will be produced in the court when the charges are framed against them.

"The two were wearing shoes during the wedding rituals. Nayar sat on the horse while he was drunk just for the sake of climbing the horse.

Also, the couple sat on the sofa when the pundit was chanting mantras near the fire," said Hastimal Saraswat, the advocate representing Khandelwal.

"All these actions are against the Hindu dharma. The two have hurt the sentiments of the Hindus and hence they should be punished for their actions."

He said that they were drunk and were also kissing each another during the rituals.

"The two had married abroad and just to humiliate Hindu religion they got married again in Jodhpur. They should be punished severely," said Khandelwal.

The case was filed against the couple under section 120(B) for criminal conspiracy and section 295(A) for
deliberate and malicious acts intended to outrage religious feelings.

While the witnesses were examined and the court was to take cognisance of the offence, the prosecutors had to get an approval from the State or Centre to prosecute them.

Saraswat said, "We are just waiting to get the permission from the State. As soon as we get the permission, we will proceed and prosecute the offenders before a court of law."
