DPIIT withdraws wedding music fee exemption, reaffirming Novex copyright licensing requirements for DJs, receptions, and events.

The Department for Promotion of Industry and Internal Trade (DPIIT) has withdrawn their last Public Notice dated 24 July 2023, which had exempted music licensing fees for weddings and related events. This withdrawal of the said notice is due to the matters of appeals related to music copyright rights (between NOVEX COMMUNICATIONS P Ltd Vs. UNION OF INDIA) that are pending before the Punjab & Haryana High Court.
Key Implications:
1. This current withdrawal of the old notice by DPIIT re- strengthens the copyright rights of NOVEX COMMUNICATIONS for issuing their NOVEX licenses for marriage oriented musical with DJ and sound recording events! It is now given to understand that Marriage ceremonies and related events (sangeet, reception, DJ AND COCKTIAL PARTY events) require licenses from copyright holder - Novex Communications.
2. Venues, organizers, and event planners must procure NOVEX COPYRIGHT LICENSE for their musical events.
3. Non-compliance may result in infringement actions, including injunctions, damages, or criminal liability.
