A hearing of the legal battle over late businessman Sunjay Kapur's inheritance was heard at the Delhi High Court on Thursday, October 9. The hearing took a dramatic turn when advocate Mahesh Jethmalani, who represents Karisma Kapoor's children in the case, compared Sunjay's widow, Priya Kapur, to the evil stepmother from the fairytale Cinderella. Jethmalani also claimed that Priya was acting in a way designed to limit Karisma's children from their father's inheritance..

Jethmalani told the court, "This is a Cinderella stepmother," claiming that Priya had already secured 60 per cent of the assets, 12 per cent for her own son, and 75 per cent of the trust. The lawyer added that she had even begun preparing Benami forms, which are used to determine company beneficiaries, in a hurry to manage the estate of her late husband.



“Who is really greedy? She has already got 60% of the assets, around 12% to her own son, and 75% of the trust. She was in such a hurry, she even started writing letters about Benami forms, which are used to decide beneficiaries of companies," Jethmalani told the Court.

He further alleged that this “glaring hurry" was Priya trying to restrict the rightful share of Sunjay Kapur’s children from his previous marriage to Karisma Kapoor. He also raised serious questions about the validity of the will, saying, “It is not possible that Sunjay Kapur would not have consulted an advocate before creating a will and bequeathing such a large estate."

The court asked if the will was typed, to which Jethmalani confirmed and pointed to several “loopholes and infirmities" in the document. He went on to argue, “This is not a normal case. There’s no reason why the executor wasn’t informed or why a lawyer wasn’t consulted. A genuine will by a well-positioned man in society does not suffer from loopholes and infirmities."

Jethmalani also alleged that the will was changed while Sunjay Kapur was on holiday with his son, adding that the person who made the changes assumed the role of a director in one of the companies just a day after the funeral. The lawyer further noted that forging a will is a serious offence punishable by life imprisonment. “This is a case where the entire justice system is being taken for a joke," he said.

About the case

The case concerns a suit filed by Karisma's children, daughter Samaira and son Kiaan, seeking a reasonable share in their late father, Sunjay Kapur's personal estate. Sunjay passed away on June 12, 2025, due to a sudden heart attack. He is survived by his second wife, Priya, their son, Azarias, his mother, Rani Kapur, and his two children from his previous marriage with Karisma.

Although Karisma herself has no direct claim in his assets, her children are contesting the will, claiming that it has been forged. The hearing has been adjourned and is scheduled to resume on October 16.
