The petition has been admitted by the HC and posted for hearing today. In her petition, K G Nagalakshmi Bai stated that the BDA should take back the site allocated to Sadananda at Nelagunte village and initiate criminal action against him.
She alleges that the CM was allotted 24.84 guntas of land and had approached the BDA seeking permission to amalgamate the site adjacent to his, which was rejected and the same was communicated to the respondent on September 24, 2009.
However, despite the BDA rules, he went ahead with construction of a shopping complex in the residential
layout. The petitioner has also submitted that the CM has further violated BDA norms and constructed five floors, when residential sites cannot exceed two floors.u00a0 She further submits that amalgamation of sites is not permitted even if the property belongs to father and son or wife and husband, unless the owner had two sites in his name.
Nagalakshmi also stated that the respondent has violated the ten-year stipulated period, which says an allottee cannot become absolute owner and also cannot converted the site into commercial area, as per his whims and fancies without permission from the BDA.
