Amid the explosive political fallout of the arrest of his former aide Bibhav Kumar in connection with the alleged assault on AAP Rajya Sabha MLA Swati Maliwal, Chief Minister Arvind Kejriwal on May 21 came out all guns blazing at the BJP-led Centre and Prime Minister Narendra Modi. Invoking the arrest of several of his party leaders, the CM, who himself is out on interim bail in connection with a money laundering case linked to the now-junked Delhi excise policy, questioned if the people elected a prime minister or a 'thanedar' (police officer). Addressing a public rally at Bhajanpura, ahead of polling for the Lok Sabha in the national capital on May 25, the AAP national convenor said, "It is up to you (people). If you vote for the 'Lotus' symbol (of the BJP), I will have to go back to jail. But if you push the 'Hand' symbol (of ally Congress), I may not have to go to jail. In a press conference on May 17, AAP alleged the ‘assault’ as BJP’s conspiracy to defame the party. Aam Aadmi Party also declared Swati Maliwal as the BJP’s ‘face and pawn’ of this conspiracy. Reacting to it, Maliwal attacked AAP and said, people who recently joined the party are now calling her a BJP agent. In her recent tweet, she said that the party was being threatened by a ‘goon’, and had taken a “U-turn” on their stand. In the ongoing Swati Maliwal assault case, Swati Maliwal’s statement has been recorded in Tis Hazari court in the presence of Judge Katyayini Sharma Kandwal. FIR has been filed in the Civil Lines police station of Delhi. The FIR Shockingly revealed the incidents from behind the rooms of Delhi CM's Residence. The FIR stated that she went to meet CM Kejriwal and was asked to wait in the drawing room. When I was told that CM was coming to meet me, I entered his PA Bibhav Kumar’s room. He immediately screamed at me and started abusing me verbally, she was stunned. She told him not to talk with her like this, and just call the CM. Finance Minister Nirmala Sitharaman on May 17 went all guns blazing on Arvind Kejriwal amid heated political slugfest sparked by the alleged assault on AAP Rajya Sabha MP Swati Maliwal by the Delhi CM's close aide. Berating Kejriwal as “shameless”, FM Sitharaman lampooned the Delhi CM for evading question related to Swati Maliwal’s alleged assault case. The Delhi police filed an FIR in connection with the alleged assault on May 16 evening, naming the Delhi CM's personal assistant, Bibhav Kumar. The Civil Lines Police registered a case under sections 354, 506, 509, and 323, among other IPC sections, for offence including assault or criminal force on a woman with intent to outrage her modesty, criminal intimidation, word gesture or acts of intent to insult, and assault.

On May 10, the Supreme Court granted interim bail to Delhi Chief Minister Arvind Kejriwal until June 1. He is required to surrender on June 2. The court did not accept his lawyer, Abhishek Manu Singhvi's, request to extend the bail until June 4. Kejriwal was arrested on March 21 by the Enforcement Directorate as part of a money laundering investigation linked to alleged irregularities in the scrapped Delhi excise policy for 2021-22.

Sanjay Singh was released from Delhi’s Tihar Jail on bail on April 3. The ED on April 2, informed the SC that the agency has no objection to Sanjay Singh getting bail. A bench led by Justice Sanjiv Khanna directed the release of Sanjay Singh . Bail was granted during pendency of trial in a money laundering case relating to excise policy irregularities. AAP workers played drums and celebrated the release of Sanjay Singh.
