Pune: Almost 13 years after a blast that left one dead and 34 injured in a mosque at Parbhani, four people, including a Pune youth were acquitted owing to lack of evidence by the Parbhani district Sessions Court on Thursday.

As per the prosecution, the incident occured on November 21, 2003. Four bike-borne youth planted two bombs at the Mohamadia mosque in Rahmat Nagar killing one person named Abdul Samad and injured around 34 people at around 1.50 pm, according to police sources. The case was being investigated by Anti Terrorist Squad (ATS).

Based on the investigation the ATS had arrested Maruti Keshwaroa Wagh, Yogesh Ravindra Deshpande from Nanded, Sanjay alias Bharauo Vittal Chaudhari and Pune-based Rakesh Dhawade. All are charged under the relevant sections of Indian Penal Code and also under Arms and Explosive Act. The police had conducted narco test on Chaudhari in Banglore.

Pune resident Dhawade was slapped under Maharashtra Control Organised Crime Act (MCOCA) and will continue to remain in prison as he is facing trail in five other cases of which three are over. He is yet to face trial in Nanded blast case and the 2008 Malegaon blast case.

Additional public prosecutor in this case said, “two eye witnesses in this case refuse to turn before the court for giving their testimony and around 53 prosecution witnesses were examined. Defence lawyers Sanjeev Punalekar, Nitin Runwal and Neeta Dhawade had argued that the four are innocent and have no connection to crime and brought to notice of court that among the 53 prosecution witnesses no one has identified or named them and hence there is no fruitful evidence.” Based on the argument the judge held in his order mentioned prosecution has failed to prove the case due to lack of evidence.
