The Delhi High Court has acquitted a 28-year-old man who was convicted in a murder case, saying he was a juvenile on the date of commission of the crime in 2000.
A Division of the Court comprising Justice B D Ahmed and Justice V K Jain quashed the sentence awarded to the convict, Sanjeev alias Vishal, after getting itself convinced of his age on reading his date of birth mentioned in the school leaving certificate issued by a government school in Delhi.
Counsel for the boy also did not challenge the judgment of the lower court in the appeal. The boy rather admitted to his crime.
However, he had sought quashing of his sentence under the Juvenile Justice (Care and Protection of Children) Act, 2000, arguing that he was a juvenile on the date of the incident as his age was less than eighteen.
The Court had earlier acquitted Sanjeev's co-accused, Sundar, in the case on the ground that he had already undergone detention for more than three years which was beyond the maximum period for which a juvenile could be sentenced to a special home under the Act.
