Out on bail, rape accused terrorises cousin's family

The mother of the 11-year-old girl reveals her living hell and speaks of the two-month ordeal they have had to endure after the rapist -- the victim's cousin, who is a minor -- was released on bail

In a city that has been shocked with incidents of rape, here is another case that exposes the torture a survivor and her family has to endure. The mother of an 11-year-old survivor, who was repeatedly raped by her cousin, is being harassed by the accused to withdraw her complaint.


“In July, this year, my sister’s 16-year-old son was arrested by the Trombay police for raping my 11-year-old daughter. But, within a week of his arrest, he was out on bail, and since then, he has been harassing us. The accused, along with his mother, have been mentally torturing us, following which I filed several police complaints against both of them. They have been threatening us, demanding that the case be taken back,” said the mother of the minor girl, whose daughter was repeatedly raped over a period of one year.


Speaking of her anguish further, the mother said, “I just hope this harassment stops. The torment has continued for two months, as they live next to our house. I have stopped going to work because I cannot leave my daughter alone. I fear she will have to suffer the horror again. My daughter is a slow learner. The boy raped her repeatedly in his house under the pretext of teaching her how to use a computer.”


Despite repeated complaints to the cops, the accused has been moving freely in the area. But, citing a bizarre reason, the cops are not taking action against the accused and his mother. “We have filed a non-cognisable offence because we cannot register an FIR in cases already lodged under sections 303 (punishment for murder by life) and 504 (intentional insult with intent to provoke breach of peace). We cannot file an FIR against the accused twice and arrest him again. We did call the accused’s parents, and asked them to shift their residence and make sure they don’t reside anywhere close to the girl’s house,” said Senior Police Inspector Prasad Manohar Dhariya of Trombay police station.

Living hell
“My daughter’s suffering began in January last year. After he violated her, she was asked to blame her grandfather. Under threat, my daughter made false allegations against her grandfather, and based on her statement, her granddad was put behind bars. However, when she continued to get abdomen pains even after the arrest, I became suspicious. I took her into confidence once again and enquired with her. She revealed that she was being raped by her cousin.”

Following the revelations by the survivor, the mother filed an FIR against the accused at Trombay police station.

On July 7, the 16-year-old accused was arrested. But a week later he was released on bail. Soon after, he began harassing the survivor and her family, tormenting them to take back the complaint.

The accused is also harassing her in the school premises because of which her parents had stopped her education and returned to their native place. “We returned three days ago and started her schooling again,” said the mother. u00a0
