The Bombay High Court, today granted suspended police sub-inspector Daya Nayak bail, two months after his arrest in a disproportionate assets case.
Justice V M Kanade granted bail of Rs 25,000 to Nayak, asking him to report to investigating officers whenever required.
He has also been asked to report to Anti-Corruption Bureau (ACB) officers twice a month till a chargesheet is filed.
Nayak, who had earlier gunned down 83 gangsters in police encounters, was granted bail after the ACB failed to file a chargesheet within the stipulated period of sixty days since his arrest on February 20 this year.
His alleged associate and co-accused Rajendra Padte had been granted bail by the High Court on April 12.
Nayak is facing charges of amassing wealth to the tune of Rs 41 lakh, disproportionate to his known sources of income.
Opposing Nayak's bail plea, the prosecution had pressed fresh charges under section 467 of IPC (forging documents).
It contended that Nayak had forged certain documents pertaining to a flat owned by him in White Rose apartments in suburban Bandra.
Under this section, the maximum punishment is ten years imprisonment, and it allows the police to file a chargesheet within ninety days instead of usual sixty.
Justice Kanade observed that this section was being added merely to get more time for filing the chargesheet, and as investigation was more or less over, bail could be granted.
"You can invite him to lunch and he would come," the Judge said in a lighter vein, directing that Nayak should attend the ACB inquiry whenever required.
