Hearing of the defamation case on 'Jolly LLB 2' was deferred to April after cast members, including Akshay Kumar and Annu Kapoor, and producer, Fox Star Studios, failed to appear in court yesterday.

The case was filed by footwear brand Bata, whose senior advocate, Neeraj Grover, alleged that "disparaging comments and defamatory reference" was made to the brand in the main trailer of the motion picture.

The actors' failure to appear in court on the scheduled first hearing was excused. The court was informed by the Delhi Police that Kumar did not receive any summons since he is currently out of town. However, Kapoor, writer Subhash Kapoor and Fox Star Studios did not turn up, despite receiving a notice from the court.

The Fox Studio counsel advocate argued that since Annu was out of India and received summons three days before the hearing, he was unable to appear before the court. On the other hand, Subhash was attending a family function in Darjeeling.

Meanwhile, the court has asked the Fox Studio counsel to submit Kumar's e-mail address and contact number.
