The Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane district has awarded a compensation of Rs 25.59 lakh to the family of a 28-year-old woman run over by a speeding tanker in 2016, reported news agency PTI.

Thane MACT member R V Mohite awarded the sum to the two minor children and the husband of the deceased, who was employed as a househelp.

A copy of the order February 25 was made available on Monday.

A speeding tanker ran over the victim, Surekha Yogesh More, while she was crossing the Bhiwandi-Kalyan road in Kongaon on May 8, 2016, reported PTI.

The tribunal noted that the tanker, driven in a "rash and negligent manner", dashed into the woman and ran her over, killing her on the spot.

The Kongaon police registered an offence under sections 279 and 304(A) of the IPC against the driver, reported PTI.

The Thane MACT noted that the insurance policy was issued to the tanker owner after the accident.

It, however, directed the insurance company to satisfy the award and then recover the sum from the vehicle owner, reported PTI.

The claimants are entitled to a compensation of Rs 25.59 lakh, the tribunal stated, adding that the amount must be paid with interest of 9 per cent per annum from the date of the petition.

Thane MACT awards Rs 94.27 lakh compensation lawyer rendered paraplegic in 2019 accident

In another case, the Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane district has awarded a compensation of Rs 94.27 lakh to a woman lawyer, who was rendered paraplegic after a road accident in 2019, reported PTI.

Thane MACT member R V Mohite directed the owner of the car that rammed into the victim's scooter and the insurer, New India Assurance Co. Ltd., to pay the compensation jointly and severally with 9 per cent interest per annum from the date of the petition, reported PTI.

A copy of the order dated February 27, was made available on Monday.

Vaishali Nitin Mohite (52), an advocate, was riding her scooter on the Nashik-Mumbai Highway on July 26, 2019, when a speeding car hit her from behind. The impact was so severe that she was dragged for several feet and crashed into a cement barrier, reported PTI.

While the claimant originally sought Rs 2 crore in damages, the tribunal assessed the just compensation based on her 100 per cent functional disability.

"The claimant is bedridden. She is suffering from traumatic paraplegia due to accidental injuries. She is suffering from 100 per cent disability. She is lying on the bed like a corpse," it noted, reported PTI.

The court rejected the insurance company's plea that the claimant was negligent or had not worn a helmet at the time of the accident, noting that the spot panchanama showed a broken helmet at the scene.

It also took note of the fact that the car driver had pleaded guilty in the criminal case.

Although the claimant's husband argued she was earning a monthly income of Rs 50,000, the tribunal fixed her notional income at Rs 25,000 per month due to a lack of documentary evidence regarding her active practice in Thane, reported PTI.

The tribunal awarded a compensation of Rs 94.27 lakh, including Rs 42 lakh for loss of future income, Rs 15 lakh for attendant charges, Rs 10 lakh for pain, suffering, and loss of amenities.
