The Bombay High Court on Monday expressed its prima facie (at first glance) opinion that gangster Abu Salem has not yet completed 25 years in jail in India, as mandated under the terms of his extradition from Portugal.
Salem had filed a petition with the High Court, seeking his release. He claimed he had already served the 25-year imprisonment term if the remission for good behaviour was taken into account.
When Salem was extradited from Portugal, the Government of India had provided assurances that he would not face the death penalty in any case and would not be imprisoned for a term exceeding 25 years, according to his plea.
On Monday, a bench comprising Justices A. S. Gadkari and Rajesh Patil admitted his petition but declined to grant any interim relief.
As per a Supreme Court order, Salem's arrest date is considered October 2005. Therefore, the High Court stated that prima facie it is clear that the 25-year period is not yet complete.
The bench added that it would take up the plea for a final hearing in due course.
