The Mumbai Police have imposed preventive restrictions prohibiting assemblies of five or more persons, processions, and the use of loudspeakers, musical instruments, musical bands, and bursting of firecrackers during processions across Brihanmumbai for 15 days from Friday, September 25.
The order, issued by Deputy Commissioner of Police (Operations) and Executive Magistrate Akbar Pathan on Tuesday, September 22, will come into effect at 12.01 am on September 25 and remain in force until midnight on Friday, October 9.
According to the order, the restrictions have been imposed based on information received from various sources indicating a likelihood of a breach of peace and public order, along with a grave danger to human life and property.
The preventive order has been issued under Section 37(3) read with Section 10(2) of the Maharashtra Police Act, 1951.
Under the order, any assembly of five or more persons is prohibited, while processions of any person are also prohibited.
The use of loudspeakers, musical instruments and musical bands, as well as bursting of firecrackers in any procession, has also been prohibited.
However, the order provides exemptions for several activities. These include marriage ceremonies, funeral assemblies, and processions on the way to crematoriums or burial grounds, and lawful meetings of companies, clubs, cooperative societies, institutions, and associations.
Social gatherings and meetings held by clubs, cooperative societies, and other societies and associations for conducting their normal business are also exempted.
Assemblies in and around cinema halls, theatres, and other places of public entertainment for watching films, dramas, or programmes are exempted from the restrictions.
The order also exempts gatherings in and around courts, government offices, and local self-government bodies for carrying out governmental or semi-governmental functions.
Assemblies at schools, colleges, and other educational institutions for educational activities, as well as gatherings in factories, shops and establishments for normal trade, business and work, are also exempted.
The order further states that other assemblies and processions may be permitted by the Zonal Deputy Commissioners of Police, Mumbai, and their supervisory officers.
The police have directed that copies of the order be displayed at prominent public places, courts, and government offices across Mumbai. It will also be publicised through loudspeakers or megaphones and other available forms of media.
The order further states that the expiry of the 15-day period will not affect the institution, continuation, or enforcement of any investigation or legal proceeding arising from the order. Any penalty, punishment, or forfeiture incurred for violating the order may also be imposed after its expiry.
