Have enough proof to nail Chintan Upadhyay, says Ujjwal Nikam

Special Public Prosecutor Ujjwal Nikam yesterday opened the case, under Section 226 of the Code Of Criminal Procedure, against artist Chintan Upadhyay, who was arrested last year for allegedly murdering his former wife, Hema Upadhyay, and her lawyer Harish Bhambhani on December 12, 2015. Stating that he had enough evidence, Nikam argued that murder charges be framed against Chintan and four other accused in the case. The Dindoshi sessions court has allowed time till July 28, following which the trial will begin.


Nikam began his argument with statements made by Pradip Rajbhar, an accused in the case, before the magistrate court (164 statement), in which Rajbhar had said that Chintan was the lead conspirator. Although Rajbhar had retracted the statement later, the special prosecutor said it was still valid evidence to prove Chintan guilty.



Citing Chintan's mobile tower location records as evidence, Nikam said the accused was in Chembur on December 8, from 6.30 pm to 7.17 pm, plotting the murder with another absconding accused Vidyadhar.

Chintan's lawyer Bharat Manghani, meanwhile, said he is waiting for statements of three friends of his client, which was recorded by the police.
