In a bid to curb illegal constructions and protect urban planning, the Mumbai Metropolitan Region Development Authority (MMRDA) on Wednesday said that it has decided to deploy officials at Special Planning Authority (SPA) zones.
In an official statement, the MMRDA said that the move is to strengthened its enforcement mechanisms in areas where it acts as the SPA.
As per orders from the Government of Maharashtra, development permissions in Palghar and Alibaug extended areas will continue to be granted by respective District Collectors until the finalization of their Development Plans. Therefore, enforcement in these areas is also under the jurisdiction of the respective collectors, it said.
It further said that under Section 53 of the Maharashtra Regional and Town Planning (MRTP) Act, 1966, designated officers have been appointed to take lawful action against unauthorised developments.
"To uphold lawful urban development, designated officers have been appointed under Section 53 of the Maharashtra Regional and Town Planning (MRTP) Act, 1966, empowering them to take timely and lawful action against unauthorised developments," the official statement said.
The MMRDA’s Planning Authority covers areas including Ambarnath, Kulgaon-Badlapur, Bhiwandi, Kalyan Growth Centre, Bandra Kurla Complex (BKC), Mumbai International Airport Notified Area, Oshiware District Centre, Wadala, and extended areas in Palghar and Alibaug.
"Development permissions in Palghar and Alibaug will continue to be granted by the respective District Collectors until the finalisation of their Development Plans, and enforcement in these areas remains under their jurisdiction," the statement said.
It said that for all other SPA zones, MMRDA officers will Iidentify unauthorised constructions, initiate legal proceedings under Sections 52 to 56 of the MRTP Act, follow a Standard Operating Procedure (SOP) for fair and transparent enforcement.
The SOP includes issuing notices, following due process, allowing appeals, and acting in line with judicial directives, it said.
"The MMRDA has adopted a strict, zero-tolerance approach, instructing officers to act swiftly, decisively, and transparently. Each case will be handled in a time-bound manner with proper documentation and hearings,: the statement said.
